The Judge hearing the case in Roseau County District Court declined the Greenbush-Middle River School (GMR) District’s request to dismiss the case. The hearing between the Middle River Annexation Property Owners Group and the GMR School District took place on August 27, 2019, and just 3 days later, Judge Donna Dixon declined to dismiss the case and is allowing the discovery phase, or gathering of information, to proceed.
Over 400 petitioners have requested the annexation of their property out of the GMR district and into the Marshall County Central School District. Some of the petitioners have indicated they feel since most of the kids from the Middle River area & Marshall County are attending the Marshall County Central School District, that they want to support them and have their tax dollars follow the students. According to their attorney: “Our group was happy that the Court is allowing us to proceed with this case. We look forward to proceeding to the discovery phase, further build our case, and ultimately to the day when these properties will be detached from the Greenbush Middle River School District.” The Middle River Group has cited how the district’s decision to not give the group consent to detach and annex was “arbitrary, capricious, and unreasonable”.
What information on the questionable approach and decisions of the GMR schoolboard will be discovered remains to be seen. How much of the taxpayer’s money is the GMR school district willing to continue to spend on Attorney expenses before they cut ties with the southern part of the district?
The whole process will take time. A Court Trial is presently scheduled on October 8 & 9, 2020.
