Polk County Attorney says deadly force against Lucas Gilbertson was justified

Polk County Attorney Greg Widseth has reviewed the materials that were sent to his office relating to the investigation into the shooting death of Lucas Paul Gilbertson on January 9, 2024. He said, based on the review, “I do not find any basis for the filing of criminal charges against any of the officers that were involved in the attempt to arrest Lucas Gilbertson on January 9, 2024.”

In the information released by the Polk County Attorney’s Office, Widseth ended the report with the following –
“Based upon all of the evidence I have reviewed as a part of this investigation, I conclude that (East Grand Forks Police Department Sergeant Aeisso) Schrage’s use of deadly force against Lucas Gilbertson was justified because it was (1) in the line of duty, (2) objectively reasonable based upon the totality of the circumstances known to him at the time, and (3) necessary to protect himself or others from death or great bodily harm caused by Lucas Gilbertson. Minn. Stat. § 609.066, subd. 2(a)(1). I also conclude that (1) Sergeant Schrage articulated with sufficient specificity the threat posed by Lucas Gilbertson, (2) the threat was reasonably likely to occur without action by Sergeant Schrage, and (3) the threat had to be addressed through the use of deadly force at that very moment. Minn. Stat. § 609.066, subd. 2(a)(1)(i-iii). Accordingly, I conclude that Sergeant Schrage’s actions were legally justified, and there is no legal basis for filing any criminal charges against Sergeant Schrage (or any other officers involved) in the events leading to Lucas Gilbertson’s death on January 9, 2024.”
